Acceptance of Terms

These Terms constitute a legally binding agreement between you and Pompton Labs, LLC, a Florida limited liability company. These Terms apply to all visitors, users, and others who access or use our services.

The Platform

Pompton Labs operates a telehealth platform that facilitates connections between individuals and licensed physicians for the purpose of evaluating and, where clinically appropriate, prescribing compounded peptide therapies. Pompton Labs is a technology and administrative services company. We are not a medical provider.

Clinical services are provided by licensed physicians employed by or contracting with an affiliated professional medical corporation operating in compliance with applicable state corporate practice of medicine laws. The medical corporation operates independently from Pompton Labs with respect to all clinical decisions.

Not Medical Advice

Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read on this website.

If you are experiencing a medical emergency, call 911 or your local emergency services immediately. Pompton Labs does not provide emergency medical services.

Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be a resident of a US state in which our physician network is licensed to practice
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from receiving our services under applicable law

By using our services, you represent and warrant that you meet all eligibility requirements. We reserve the right to terminate your access if we determine that you do not meet these requirements.

Accounts & Waitlist

When you join our waitlist, you provide your email address and consent to receive communications from Pompton Labs about our launch, services, and related topics. You may unsubscribe at any time.

Waitlist position is determined by order of signup. We make no guarantee regarding when or whether waitlist members will receive access to our services, or the specific terms under which access will be offered.

When you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion, with or without notice.

Clinical Services

Access to clinical services through our platform is subject to physician evaluation and discretion. Pompton Labs does not guarantee that any individual will be deemed an appropriate candidate for peptide therapy or that any specific therapy will be prescribed.

By using our clinical services, you acknowledge and agree that:

• All treatment decisions are made solely by the prescribing physician, not by Pompton Labs
• You will provide accurate and complete health information during the intake and evaluation process
• You will disclose all current medications, supplements, and health conditions to your physician
• You will follow your physician's instructions regarding treatment protocols and monitoring
• Peptide therapy carries risks, which your physician will discuss with you prior to prescribing
• Results of any therapy are not guaranteed and will vary by individual

Compounded Medications

Compounded medications dispensed through our platform are prepared by PCAB-accredited compounding pharmacies pursuant to a valid physician prescription. You acknowledge and agree that:

• Compounded medications are not FDA-approved drugs and have not undergone FDA review for safety, efficacy, or manufacturing quality
• Compounded medications are prepared for individual patients based on a valid prescription and are not commercially available FDA-approved equivalents
• The prescribing physician has determined that a compounded medication is appropriate for your specific clinical situation
• You will use compounded medications only as directed by your physician
• You will store and handle medications as instructed
• You will not share medications with any other individual

Payments & Refunds

Fees for our services will be disclosed clearly prior to any transaction. By providing payment information, you authorize us to charge the applicable fees. All fees are in US dollars.

Consultation fees are generally non-refundable once a physician consultation has been completed. If a physician determines that you are not an appropriate candidate for therapy, we will work with you on a case-by-case basis regarding any applicable fees.

Medication orders that have been compounded and shipped cannot be returned due to the nature of compounded medications and applicable pharmacy regulations. Please contact us promptly if you have questions or concerns about your order.

We reserve the right to modify our pricing at any time, with notice provided to existing members.

Prohibited Conduct

You agree not to:

• Provide false, inaccurate, or misleading information to Pompton Labs or to any physician on our platform
• Use our services for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to obtain prescriptions under false pretenses or for any purpose other than your own personal use
• Share, sell, or transfer any medications obtained through our platform to any other individual
• Attempt to circumvent or interfere with the security or integrity of our platform
• Use our platform to harass, threaten, or harm any individual
• Reproduce, distribute, or exploit any content from our platform without our prior written consent
• Use automated tools to access or scrape our platform

Intellectual Property

All content on pomptonlabs.com — including text, graphics, logos, design, and software — is the property of Pompton Labs, LLC or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on our platform without our express written permission. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

Disclaimers

We do not warrant that our platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any clinical outcomes will result from use of our services.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Limitation of Liability

To the maximum extent permitted by applicable law, Pompton Labs, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or related to your use of our services.

In no event shall our total liability to you for all claims arising out of or related to these Terms or our services exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) $100.

These limitations apply regardless of the legal theory on which the claim is based and even if we have been advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Pompton Labs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to your use of our services, your violation of these Terms, or your violation of any rights of another party.

Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction in those courts.

Before initiating any legal proceeding, you agree to first contact us and attempt to resolve any dispute informally by sending written notice to [email protected]. We will attempt to resolve the dispute informally within 30 days of receipt of your notice.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.

If you do not agree to the modified Terms, you must stop using our services.
